Terms of Service

1. Who Can Use einblick

The platform serves multiple types of users:

• General Public: Any Individuals who wants to do a research study with their customers or potential target customers:
• Researchers associated with research institutions or with on organisation: Organisations that access the platform to design research studies, monitor digital presence, and connect third-party platforms (such as Meta and YouTube) for intelligence gathering.
• Respondents: Individuals who participate in surveys or AI-moderated interviews.

You must be at least 18 years of age to use this platform. einblick does not knowingly collect data from individuals under 18.

2. Research Participation and Reward Distribution

For individuals acting as respondents on our platform, we occasionally distribute incentives such as coupons. The following terms govern your participation:

• Response Validation: We maintain strict data quality standards. All submitted responses are rigorously validated using both our proprietary internal algorithms and human agent reviews. We evaluate responses for thoughtfulness, accuracy, and adherence to instructions.
• Subject to Validity: The distribution of any coupon or reward is strictly subject to the successful validation of your responses. We reserve the right, at our sole discretion, to reject responses and withhold rewards if we determine a submission is fraudulent, low-effort, automated (e.g., bot-generated), or otherwise in violation of these Terms.
• Coupon-Specific Terms: Each distributed coupon or reward is governed by its own specific validity period, redemption instructions, and terms and conditions. These details are provided alongside the specific coupon. Respondents are entirely responsible for reading, understanding, and abiding by those individual coupon terms.
• Profile Linking: Coupons are exclusively linked to the verified respondent profile that successfully completed the study. They are non-transferable unless explicitly stated otherwise.

3. Third-Party Services and API Integrations

The Monitor module utilizes third-party Application Programming Interfaces (APIs) to aggregate data and provide analytics services. You may only connect accounts and properties (such as YouTube Channels, Facebook Pages, or Instagram Business accounts) that you have explicit legal authority to manage, and you must adhere to the rules of those respective platforms.

• YouTube API Services: By connecting your YouTube account, you acknowledge that our platform uses YouTube API Services. You explicitly agree to be bound by the YouTube Terms of Service and the Google Privacy Policy. We request read-only access and use this data solely to deliver the analytics you request.
• Meta Graph API: By connecting your Meta, Facebook, or Instagram accounts, you agree to be bound by Meta's Terms of Service and their associated Platform Terms and policies. We access only the Pages and linked Instagram Business accounts you select, together with their insights.
• WhatsApp Verification: Identity verification codes (OTP) are delivered over the Meta WhatsApp Cloud API as transactional messages. By providing a WhatsApp-enabled number, you consent to receiving these verification messages, which are also governed by WhatsApp's terms.
• Data Revocation: You retain full control over your integrations. You can disconnect third-party access at any time via the respective platform's settings (e.g., the Google Security Settings, or your Meta Business Integrations / App Settings). Removing our app from Meta also triggers our automated data-deletion process.

4. Our Commitment and Disclaimers

• Data Integrity: We maintain high standards of data security and research integrity when processing API data and survey responses.
• Service Availability: While we strive for continuous service, we cannot guarantee the uninterrupted availability of third-party APIs. We are not liable for data syncing delays caused by upstream platforms (e.g., Meta or Google).

5. User Obligations

By utilizing our platform, you agree to:

• Provide honest and accurate information.
• Not attempt to reverse-engineer, exploit, or attack the platform's security, validation algorithms, or API integrations.
• Only connect accounts and properties (like YouTube Channels or Facebook Pages) that you have explicit legal authority to manage.

6. Intellectual Property

All platform code, AI models, contextual analysis methodologies, validation algorithms, and branding are the exclusive intellectual property of Innodrive Consulting. Any data imported from third-party platforms remains subject to their respective ownership terms. Research responses become the property of Innodrive Consulting or its clients upon submission.

7. Beta Phase — Specific Terms

The platform is provided "as is" during the closed beta phase. Features may change, and the availability of specific third-party integrations may fluctuate based on API approval statuses.

8. Plans, Credits and Usage

einblick is offered through tiered subscription plans (such as Free, Standard, and Professional) and an Enterprise option. Access to features is governed by a credit-based system.

• Credits: Each plan grants a defined allocation of credits used to operate the platform. Credits are an internal usage unit and do not represent a cash balance, monetary value, or stored money, and are not redeemable for cash. Unless explicitly stated otherwise, unused credits do not roll over across billing periods.
• Credits vs. Study and Respondent Limits: Credit consumption is separate from, and in addition to, plan limits on the number of research studies and respondents per study. The number of respondents you can collect and the number of studies you can run are governed by your plan tier.
• A detailed policy explaining exactly how credits are consumed relative to respondent counts and study limits is being finalised and will be published shortly.

9. Payments, Razorpay and Taxes

Paid subscriptions are billed through our payment partner, Razorpay.

• Why We Use Razorpay: We use Razorpay so that your sensitive payment-instrument details are handled by a secure, PCI-DSS-compliant processor. einblick never receives or stores your full card, UPI, or net-banking credentials. By paying, you also agree to Razorpay's terms and policies.
• Pricing and GST: Prices are shown in INR and are exclusive of applicable taxes. 18% GST is added and displayed at checkout. A GST-compliant tax invoice is issued for each successful payment.
• Billing Cycle and Cancellation: Subscriptions renew according to the selected billing cycle. You may cancel at any time; cancellation takes effect at the end of the current paid period, after which your account reverts to the Free plan. Except where required by law, payments are non-refundable for the period already commenced.
• Detailed refund, dispute, and billing-adjustment terms for this section are being finalised and will be published shortly.

10. Respondent Sourcing Responsibility

On self-serve plans — including the Free, Standard, and Professional tiers — sourcing, recruiting, and inviting respondents to your studies is your responsibility as the user, not the responsibility of einblick or Innodrive Consulting.

We provide the tools to design studies, collect responses, and analyse results, but we do not guarantee the availability, volume, or quality of respondents on these plans. You are responsible for ensuring that any respondents you engage have consented to participate and that your recruitment complies with applicable law. Managed respondent sourcing, where offered, is available only under specific or Enterprise arrangements.

11. AI Services — Accuracy and Limitations

The platform uses artificial intelligence across questionnaire generation, AI-moderated interviews, response validation, and insight synthesis.

• AI Can Make Mistakes: AI-generated outputs may contain errors, omissions, or inaccuracies. You must review all AI-generated content thoroughly before relying on it. Such outputs are provided for assistance only and do not constitute professional, legal, financial, or research advice.
• AI Sub-Processors: AI features are delivered using trusted third-party AI providers (including Google Gemini and Sarvam AI) acting as our sub-processors, as described in our Privacy Policy. We apply data-minimisation safeguards before content is processed.
• Your Responsibility: You remain responsible for the studies you publish, the questions you ask, your compliance with applicable law (including obtaining respondent consent), and any decisions you make based on AI-assisted insights.

12. Disclaimers and Limitation of Liability

The platform is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. To the maximum extent permitted by applicable law, Innodrive Consulting shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or in connection with your use of the platform. Our total aggregate liability for any claim relating to the platform shall not exceed the amounts you paid to us for the service in the three (3) months preceding the event giving rise to the claim. You agree to indemnify and hold Innodrive Consulting harmless against claims arising from your misuse of the platform or breach of these Terms.

13. Changes, Termination and Governing Law

• Changes to These Terms: We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date, and your continued use of the platform constitutes acceptance of the revised Terms.
• Termination: We may suspend or terminate access for breach of these Terms, fraudulent activity, or as required by law. You may stop using the platform at any time.
• Governing Law and Jurisdiction: These Terms are governed by the laws of India, and the courts at Chennai, Tamil Nadu shall have exclusive jurisdiction over any disputes.
