Terms of Service

1. Who Can Use einblick

The platform serves two types of users:

• Research Clients (Companies): Organisations that access the platform to design and commission research studies. Access is granted by invitation and subject to organisational verification.
• Respondents: Individuals who participate in surveys or AI-moderated interviews. Respondents may participate anonymously (without an account) or as registered panellists.
• Internal Research: We also conduct our own independent research to generate industry-wide benchmarks and intelligence reports.

You must be at least 18 years of age to use this platform. einblick does not knowingly collect data from individuals under 18. If we discover a minor has submitted data, it will be immediately deleted.

2. Our Commitment to You

What We Promise

• Research Integrity: We maintain the highest standards of research data integrity. All surveys are reviewed before publication to ensure they are ethical and do not exploit respondents.
• Anonymity by Default: Respondents' identities are never disclosed to Research Clients without explicit consent. Aggregated and de-identified data is the default output format.
• Transparency: We disclose what data is collected, why, and how it is used, as detailed in our Privacy Policy.
• Fair Rewards: Rewards listed for survey participation are genuine. We commit to processing reward claims for eligible respondents within the timeframe communicated in each study.
• Security: We apply industry-standard security measures including encryption at rest and in transit, access controls, and bot prevention.
• Responsiveness: Grievances submitted to info@innodrive.in will be acknowledged within 48 hours and resolved within 30 days.

3. Respondent Obligations

By participating in any survey or interview, you agree to:

• Provide honest and accurate responses. Deliberately misleading surveys, providing contradictory answers, or attempting to game reward systems constitutes a breach of these Terms.
• Participate only once per survey unless explicitly invited again. Circumventing duplicate-submission controls (cookie clearing, VPN use to bypass IP detection) is prohibited.
• Not attempt to reverse-engineer, probe, or attack the platform's security or AI systems.
• Not submit harmful, offensive, or illegal content in any open-ended text or audio response. Content moderation systems are active on all audio submissions.

Violations will result in disqualification from current and future studies, forfeiture of any pending rewards, and may result in legal action if platform security is materially compromised.

4. Research Client Obligations

Organisations using einblick to commission research agree to:

• Use research data only for the purpose disclosed to respondents at the time of participation.
• Not attempt to re-identify respondents from anonymised datasets.
• Comply with all applicable Indian and international data protection laws when using research outputs.
• Not commission surveys that collect data for unlawful, deceptive, or discriminatory purposes.
• Honour any reward obligations specified in the study design, fulfilled through the einblick platform.

5. Beta Testing Phase — Specific Terms

During the current closed beta testing phase:

• The platform is provided "as is" and "as available" without warranty of any kind.
• Features may change, and certain data collected during beta may be reset or altered as the platform matures. We will provide advance notice where possible.
• Participation in the beta constitutes your agreement to provide honest feedback to help improve the platform (via the post-survey feedback form).
• Reward payouts during beta are managed on a best-effort basis and are subject to successful completion and data quality verification.

6. Intellectual Property

All platform code, AI models, branding, interfaces, and research methodologies are the exclusive intellectual property of Innodrive Consulting, protected under the Copyright Act 1957 and other applicable Indian intellectual property laws.

Research outputs (aggregated insights, reports, AI analysis) generated from a commissioned study are owned by the Research Client who paid for that study, subject to their agreement with us.

For Internal Research conducted by einblick, all raw data, analysis, and final reports are the exclusive property of Innodrive Consulting Services Private Limited. We reserve the right to sell these anonymised, aggregated reports to third parties.

Respondents grant einblick a limited, non-exclusive, royalty-free licence to process their submitted responses and audio recordings solely for the purpose of generating research insights and improving the platform's AI systems. This licence is revocable by requesting data deletion per the Privacy Policy.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Innodrive Consulting shall not be liable for:

• Indirect, incidental, or consequential losses arising from use of the platform.
• Service interruptions, data loss, or feature unavailability during the beta phase.
• Actions taken by Research Clients using research data beyond the agreed scope.

Our direct liability in any matter shall not exceed the total amount paid by you to einblick in the preceding 3 months, or ₹5,000 INR, whichever is greater.

8. Termination

We reserve the right to suspend or terminate access for any user or organisation that breaches these Terms, without prior notice. Respondents may stop participating at any time. Research Clients may terminate their account by contacting info@innodrive.in.

9. Grievance Redressal

In accordance with Rule 5(9) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021, we designate the following Grievance Officer:

If no resolution is reached within 30 days, you may escalate to the Data Protection Board of India (once operational) or approach a court of competent jurisdiction in India.

10. Governing Law

These Terms are governed by the laws of India, including:

• Digital Personal Data Protection Act (DPDPA) 2023
• Information Technology Act 2000
• Consumer Protection Act 2019
• Copyright Act 1957

Any dispute shall be subject to the exclusive jurisdiction of the courts in India.
